Welcome to AussieFlatmates.com.au ABN: 34198740287 ("we," "our," or "us"). These Terms and Conditions govern your use of the AussieFlatmates website and services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these terms.

1. Services

1.1 AussieFlatmates.com.au is an online Share accommodation & Property listing platform that connects individuals searching for shared accommodation and property owners offering accommodation in Australia. Our services include property and room listings, flatmate matching services, virtual property tours, communication tools between members, and property search tools.

1.2 We act solely as an intermediary platform connecting property owners/managers and potential tenants/flatmates. We do not act as a real estate agent, provide legal advice, guarantee the accuracy of listings, participate in rental agreements, or handle rental payment between parties

1.3 Our services also include: Connecting students and tenants to homeowners; facilitating shared housing and roommate matching; helping tenants find accommodation by desired type and location; and providing a listing platform for property owners and landlords.

2. Membership and Account

2.1 We offer two membership tiers to accommodate different user needs. Free Membership includes basic account registration, the ability to browse listings, limited interaction with other free members, and basic search functionality. Premium Membership provides full access to all platform features, including video uploads capability, Google View and map integration, direct messaging with all members, access to mobile numbers of other premium members, priority listing placement, social media integration, and enhanced search capabilities.

2.2 To use our services, you must be at least 18 years old, provide accurate, current, and complete information, complete our verification process, and maintain the security of your account credentials. All users must verify their accounts for safety purposes. Our verification process may include email verification, phone number verification, identity document verification, and additional verification steps as required.

During account creation, you may be required to verify your mobile number via a verification code sent by SMS before uploading content or interacting with other users.

3. Fees and Payments

3.1 Payment for Premium Membership must be made in Australian Dollars (AUD) using one of our accepted payment methods. By purchasing a Premium Membership, you authorise us to charge your chosen payment method for the membership fees at the then-current rates.

Premium Memberships are billed monthly in advance. Unless otherwise stated, memberships will automatically renew for additional monthly periods at the then-current rate unless cancelled by you at least 2 days before the end of the current period. You can cancel automatic renewal at any time through your account settings or by contacting us at support@aussieflatmates.com.au.

3.2 We reserve the right to change our membership fees upon notice to you. If we change our membership fees, we will provide you with notice of the change 30 days before the change

takes effect. Your continued use of the Premium Membership after such notice constitutes your acceptance of the new fees.

3.3 We offer a 48-hour refund period for premium memberships. Additionally, if a premium member does not find a flatmate within their one-month membership period, they are eligible for a free one-month extension. Refund requests must be submitted in writing to our support team, and extension requests must be submitted before the current membership expires.

4. Content and Listings

4.1 All content posted on our platform must be accurate and truthful, owned by you or posted with permission, compliant with Australian law, free from discriminatory language, and clear and descriptive. Property listings must include accurate location information, current rental prices, available move-in dates, accurate property descriptions, current photos/videos, and complete amenity information.

4.2 Users must not post content that is false, misleading, or deceptive, violates any laws or regulations, infringes on others' rights, contains inappropriate or offensive material, promotes discrimination, or contains spam or unauthorised advertising.

4.3 Users are responsible for updating and removing their listings when the property is no longer available or their accommodation needs are met. Listings inactive for 15 days or more may be removed without prior notice.

4.4 You are solely responsible for assessing any users who respond to your listings and determining their suitability. AussieFlatmates does not conduct background or identity checks on users and accepts no liability for interactions between users.

5. User Conduct and Safety

All users must provide accurate information, maintain professional communication, report suspicious activity, update listings promptly, and respect others' privacy and rights. The platform prohibits harassment or discrimination against other users, sharing false or misleading information, circumventing our messaging system, creating multiple accounts, scraping or copying platform content, and sharing account access.

6. Privacy and Data Protection

We collect and process personal information as outlined in our Privacy Policy. This includes account information, usage data, communication content, payment information, and verification documents. We use collected data to provide our services, improve user experience, ensure platform safety, communicate with users, and comply with legal obligations.

7. Disclaimers

7.1 AussieFlatmates does not guarantee the accuracy of listings, verify property ownership, or take responsibility for rental agreements. We do not guarantee matching success and are not liable for user interactions.

7.2 Users are solely responsible for verifying property information, conducting appropriate due diligence, following local rental laws, ensuring personal safety, protecting personal information, and complying with all applicable laws and regulations. We strongly recommend that users conduct their own verification and due diligence before entering into any agreements or making any payments.

7.3 We do not independently verify any property, landlord, tenant, or user information provided in listings or profiles. You rely on such information entirely at your own risk.

8. No Warranties

We make no warranties or representations about the accuracy, completeness, security, or reliability of any content posted on the Platform. You acknowledge that any reliance upon such content is at your own risk. We do not guarantee the accuracy of listings, verify property ownership, conduct background checks on users, or take responsibility for rental agreements. We do not guarantee matching success or the suitability of any user or property for your needs.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, AussieFlatmates, its directors, employees, agents, and representatives exclude all liability for any loss or damage of any kind (including but not limited to direct, indirect, special, or consequential loss, loss of profits, loss of data, loss of opportunity, and economic loss) arising out of or in connection with: (a) your use of, or inability to use, the Platform; (b) any content posted, transmitted, or otherwise made available through the Platform; (c) any arrangements made between users of the Platform; (d) any acts or omissions of other users of the Platform; (e) any property damage or personal injury arising from use of the Platform; (f) any errors, mistakes, or inaccuracies in relation to the Platform; or (g) any unauthorised access to or use of our systems.

9.2 Our total liability to you for any and all claims arising out of or in connection with these terms or your use of the Platform, regardless of the form of action, will be limited to the amount you have paid to us (if any) in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify AussieFlatmates, its officers, employees, agents, contractors, and related entities (each an Indemnified Party) against all losses, damages, costs (including legal costs on a full indemnity basis), and expenses which any Indemnified Party may incur, suffer, or become liable for as a consequence of or in connection with your use of the Platform or breach of these Terms.

11. Intellectual Property

11.1 The Platform, including all content, features, functionality, software, designs, trademarks, logos, and interfaces, is owned by or licensed to AussieFlatmates and is protected by Australian and international intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property.

11.2 By posting, uploading, or submitting any content to the Platform ('User Content'), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content for the purpose of operating and improving the Platform. You warrant that you own or have the right to grant this license for all User Content you submit.

11.3 You retain ownership of your User Content. However, you acknowledge that any suggestions, ideas, or feedback you provide regarding the Platform may be used by us without any obligation to compensate you.

11.4 We may remove any User Content that we reasonably believe violates these Terms, infringes intellectual property rights, or is otherwise inappropriate for the Platform.

You must not:

•(a) copy, modify, or create derivative works of the Platform or any content;
•(b) reverse engineer or attempt to extract our source code;
•(c) use our trademarks or branding without our prior written consent; or
•(d) remove or alter any copyright, trademark, or other proprietary notices."

12. Termination

We may terminate or suspend accounts for terms violation, inappropriate behaviour, false information, extended inactivity, or at our discretion. Upon termination, access to premium features ends, content may be removed, and no refund will be provided (except within the 24-hour period). User data will be handled in accordance with our Privacy Policy.

We may take legal action against users who post unlawful, offensive, or harmful content, or otherwise violate these Terms. Users are responsible for safeguarding their personal information and should avoid posting sensitive data on the Platform.

13. Changes to Terms

We reserve the right to modify these terms at any time. Users will be notified of significant changes via email notification, platform announcement, or notice on login.

15. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from or relating to these terms, or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
